Jamie Dupree's Washington Insider: Reporters get a Supreme Court reminder

Through the years that I have covered news in Washington, D.C., I have always tried to follow one rule - don't try to predict what the Supreme Court is going to do on a certain case. That was driven home this week by decisions in several major cases of the Court's 2011-2012 term.

On Monday, Chief Justice John Roberts - who has been villified by Democrats in recent years - joined with more liberal Justices to strike down three different provisions of an Arizona immigration law that was championed by many Republicans.

On the same day, Roberts also dealt Democrats a rebuke on a campaign finance case by overturning a Montana state law that had restricted corporate contributions to political candidates, upholding the controversial Citizens United ruling of 2010 that drew a Presidential rebuke in a State of the Union Address.

Then on Thursday, the Chief Justice - nominated by President George W. Bush - joined with the four more liberal members of the Court to deliver a major political victory to the President by voting to uphold the Obama health law.

If you put $5 on that Judicial Pick Three at the beginning of the week, the payoff would have been pretty good, because those may not have been what many people might have predicted for the Chief.

"Obviously, for conservatives and many supporters of federalism, this will be viewed as the Brutus moment with regard to Roberts," wrote legal expert Jonathan Turley.

It was a turn of events that had been discussed several months ago - Roberts siding with the liberals to save the Obama health law - but it hadn't been given much attention in recent weeks.

For Roberts to deliver such an important victory to the Obama Administration was even more supremely ironic, given that Senators Obama and Biden had both voted against the Chief Justice's nomination in 2005.

"My job is to call balls and strikes and not to pitch or bat," Roberts said in his Senate confirmation hearings, a line that was repeatedly spit back in his face by Democrats, who routinely accused the Chief Justice of embracing ultra-conservative positions.

The turn of events on Thursday left GOP lawmakers scratching their heads.

"He's a brilliant constitutional lawyer," said Sen. Johnny Isakson of Georgia, who passed on the opportunity to criticize the Chief Justice in an interview.

"I think the Supreme Court got it wrong," said Rep. John Sullivan of Oklahoma.

"I was surprised the Supreme Court appears to let all of the law stand," said Rep. Frank Lucas of Oklahoma.

"It doesn't change the fact that it's a bad law," said Rep. Dan Webster of Florida.

"I certainly was surprised with where the swing vote came down, with the Chief Justice," said Rep. Austin Scott of Georgia, "but I respect him as a man and respect the Court."

Republicans vowed to overturn the law, arguing they will benefit politically for November by making it one of their main campaign goals.

Reporting on the Supreme Court

On Monday this week, I visited my company's main flagship radio station in Atlanta and was on the air live with Neal Boortz trying to flesh out the Arizona immigration ruling.

The initial news reports indicated a "split" decision, but as I wrote in a blog that night, it seemed to me that the real story was a defeat for the states and a victory for the Federal Government by stating that the feds were in charge of immigration policy and enforcement.

As I was rushing out of the station on Monday afternoon, I stopped to talk to a few of my colleagues and told them of how nervous I get reporting on Supreme Court rulings, because they can often be very complicated to dissect - especially when you are trying to get the news out quickly.

I thought of that on Thursday morning as I was faced with competing assessments of the Obama health law - CNN and Fox News were reporting that the individual mandate has been struck down; other outlets were giving a different story.

I was live on the air and made the decision to play for time, to talk about how there were different stories, instead of deciding that one was correct.

It was a good decision.

In the end, CNN and Fox were both wrong, and they had to backtrack.

Some colleagues of mine who work at one of the other major TV networks gathered on Thursday night in Washington, D.C. for drinks after work - marking how they didn't get that news wrong on the air.

There should have been an easy way to figure out which way the ruling was going, since the majority was formed by Chief Justice Roberts and the four more liberal Justices.

This is what was at the end of the opening "Syllabus," which summarizes the decision of the Supreme Court:

"ROBERTS, C. J., announced the judgment of the Court and delivered the opinion of the Court with respect to Parts I, II, and III?C, in which GINSBURG, BREYER, SOTOMAYOR, and KAGAN, JJ., joined; an opinion with respect to Part IV, in which BREYER and KAGAN, JJ., joined; and an opinion with respect to Parts III?A, III?B, and III?D. GINSBURG, J., filed an opinion concurring in part, concurring in the judgment in part, and dissenting in part, in which SOTOMAYOR, J., joined, and in which BREYER and KAGAN, JJ., joined as to Parts I, II, III, and IV. SCALIA, KENNEDY, THOMAS, and ALITO, JJ., filed a dissenting opinion. THOMAS, J., filed a dissenting opinion."

It's almost the definition of confusing.

And when you are racing against the clock - and against your competition - sometimes mistakes can be made.

It was a brutal reminder - don't try to predict the Supreme Court's rulings and take your time in reporting on their decisions.

(AP) ? A conference called by special envoy Kofi Annan to end the Syria crisis appeared on the brink of failure as it opened Saturday, with the U.S. and Russia still divided over a role for President Bashar Assad in a transition government.

Annan seemed confident of his plan a few days ago, but Russia has refused to back a provision that would call for Assad to step down to make way for a unity government, a stance that could scuttle the entire deal.

The envoy warned the permanent members of the U.N. Security Council ? Britain, China, France, Russia and the United States ? that if they fail to act at the talks hosted by the United Nations at its European headquarters in Geneva they face an international crisis of "grave severity" that could spark violence across the region and provide a new front for terrorism.

"History is a somber judge and it will judge us all harshly if we prove incapable of taking the right path today," he said.

He appeared to specifically aim his words at Russia, Syria's most important ally, protector and arms supplier, which insists that outsiders cannot order a political solution for Syria. The U.S. is adamant that Assad should not be allowed to remain in power at the top of the transitional government and there is little chance that the fragmented Syrian opposition would go along with any plan that does not explicitly say Bashar must go.

"While many spoke of united support for one ... some simultaneously took national or collective initiatives of their own, undermining the process. This has fueled uncertainty in Syria, in turn fueling the flames of violence," Annan said. "By being here today, you suggest the intention to show that leadership. But can you, can we follow through?"

He said that "the way things have been going thus far ? we are not helping anyone. Let us break this trend and start being of some use."

Foreign ministers were rushed from luxury sedans into the elegant and sprawling Palais des Nations along with their legions of diplomats and aides and envoys from Europe, Turkey and three Arab countries representing groups within the Arab League.

A senior U.S. official ? speaking on condition of anonymity due to the sensitivity of the ongoing negotiations ? said the "discussions remain challenging. We're continuing to work this today, but we need a plan that is strong and credible. We may get there, we may not."

The question is still whether Russian Foreign Minister Sergey Lavrov and U.S. Secretary of State Hillary Rodham Clinton can rescue Annan's plan.

Russia and China, which has followed Russia's lead on Syria, have twice used their council veto to shield Syria from U.N. sanctions.

Major regional players Iran and Saudi Arabia were not invited. The Russians objected to the Saudis, who support the Syrian opposition. The U.S. objected to Iran, which supports Assad's regime. Lavrov predicted the meeting had a "good chance" of finding a way forward, despite the grim conditions on the ground.

Syria, verging on a full-blown civil war, has endured a particularly bloody week, with up to 125 people reported killed nationwide on Thursday alone. Since March of last year, the uprising in in one of the world's most unstable regions has killed some 14,000 people.

International tensions also heightened last week after Syria shot down a Turkish warplane, leading to Turkey setting up anti-aircraft guns on its border with its neighbor.

Without agreement among the major powers on how to form a transitional government for the country, Assad's regime ? Iran's closest ally ? would be emboldened to try to remain in power indefinitely, and that would also complicate the U.S. aim of halting Iran's nuclear goals.

At talks Friday night, top U.S. and Russian diplomats remained deadlocked over the negotiating text to agree on guidelines and principles for "a Syria-led transition."

British Foreign Secretary William Hague urged Russia and China, which is following the Russian lead, to join Western nations in speaking with one voice on Syria, though he acknowledged that will be a stiff challenge.

"We haven't reached agreement in advance with Russia and China ? that remains very difficult. I don't know if it will be possible to do so. In the interest of saving thousands of lives of our international responsibilities, we will try to do so," Hague told reporters. "It's been always been our view, of course, that a stable future for Syria, a real political process, means Assad leaving power."

He tweeted that "President Assad and his closest associates cannot credibly lead the process of transition in Syria.

The negotiating text for the multinational conference calls for establishing a transitional government of national unity, with full executive powers, that could include members of Assad's government and the opposition and other groups. It would oversee the drafting of a new constitution and elections.

But the text that would serve as the framework for Annan's peace efforts also would "exclude from government those whose continued presence and participation would undermine the credibility of the transition and jeopardize stability and reconciliation."

"Ultimately, we want to stop the bloodshed in Syria. If that comes through political dialogue, we are willing to do that," said Khalid Saleh, a spokesman for the Syrian National Council, a coalition of Syrian opposition groups based in Istanbul, Turkey. "We are not willing to negotiate (with) Mr. Assad and those who have murdered Syrians. We are not going to negotiate unless they leave Syria."

Clinton said Thursday in Riga, Latvia, that all participants in the Geneva meeting, including Russia, were on board with the transition plan. She told reporters that the invitations made clear that representatives "were coming on the basis of (Annan's) transition plan."

The United Nations says violence in the country has worsened since a cease-fire deal in April, and the bloodshed appears to be taking on dangerous sectarian overtones, with growing numbers of Syrians targeted on account of their religion. The increasing militarization of both sides in the conflict has Syria heading toward civil war.

In this age of new media, social media networks provide great tools for communicating with your customers, clients, fans and followers. Below are a few tips for using social media when launching your next new product:

1. In the days before your product launch generate buzz about your new product on your social networking sites. Create status updates in Facebook, Twitter and LinkedIn letting your fans and followers know that something new is on the way. Create engagement by taking a photo of a part of the new product and post on Pinterest, Facebook or Instagram and invite your followers to guess what it is.

2. Announce your new product on your social networks to allow your followers to be the first to get the details. These are your loyal followers and they deserve a reward for their loyalty! Depending on your product, you may wish to create a new Facebook Page or Twitter account for the product. If so, invite your current fans and followers to your new profiles.

3. Create a video featuring your new product and post on YouTube. Be sure to share links to your various social networks.

4. Create a Twitter hashtag for your product and generate conversation about your product. Ask for opinions, people love to give their opinions, and then use that feedback to improve your product and customer experience.

5. Create Facebook Ads for your product to help drive traffic and create awareness among those who are not yet your followers.

6. Don?t forget your email database! Be sure to send an email blast linking to your social networks for more information. Encourage them to share the news of your new product.

7. Run contests giving away your new product or contests aimed at improving engagement, such as photo or video contests. Be sure to market those campaigns across your social networks.

8. And last, but certainly not least, be sure to utilize your blog! Content and traffic on social networking sites is great, but even better is to give those viewers somewhere to learn more about your product, your industry, your expertise and your company.

YORK, Maine ? A Seacoast Baseball Academy coach has been arrested by Concord, N.H., police and charged with aggravated felonious sexual assault of juveniles.

Robert A. Joubert, 58, of Manchester, N.H., no street address given, was arraigned on four Class A felony counts of aggravated felonious sexual assault and one Class A misdemeanor count of sexual assault Thursday afternoon. He was scheduled to be arraigned in Concord District Court. However, arraignment took place at Concord Hospital as Joubert was transported there with a medical condition, according to Lt. Timothy O'Malley, commander of the Criminal Investigations Division with Concord police.

Joubert's bail was set at $450,000 cash.

The charges out of Concord allege there is more than one victim, all male juveniles at the time of the alleged assaults, according to O'Malley.

?It was pattern sexual assaults over a period of time between 1995 and 2004 in Concord,? O'Malley said.

Joubert was a coach with the Seacoast Baseball Academy, which is located at 1050 Route 1, in York, Maine, according to its Web site. The building is known as the York Sports Center. The owner of the building is listed as York Sports and Health Center, LLC, Dirigo Sport Center in Medford, Mass., according to information on the town of York's assessing database. No one with the business could be reached for comment Thursday.

The Seacoast Baseball Academy Web site features numerous testimonials praising the coaching of Joubert. The positive comments are attributed to parents from York and the New Hampshire communities of North Hampton, Rye and Somersworth.

According to the Seacoast Baseball Academy Web site, Joubert has provided lessons to athletes from York and Berwick in Maine, and Exeter, Dover, Durham, Hampton, North Hampton, Portsmouth, Rye and Stratham in New Hampshire.

The Seacoast Baseball Academy is not, and has never been, affiliated with the York Parks and Recreation Department, according to the town's Parks and Recreation Director Mike Sullivan.

According to a York Little League official who declined to be identified, Joubert was never directly affiliated with the league, but did help out with players and coaches from time to time. His background checks came back negative, he said.

Joubert was a contract coach out of the York Sports Center, according to York Police Chief Doug Bracy. There are no charges against Joubert out of York, he said.

?Our concern is to do a timeline and follow him to acquaintances to find out whether there are other victims,? Bracy said.

Bracy said the investigation began earlier this year with an e-mail he received concerning Joubert, which he forwarded to investigators.

In March this year, the York Police Department received a complaint alleging that Joubert had been engaged in inappropriate sexual contact with minors, according to O'Malley. As a result of information developed in York's investigation, the FBI was contacted. The FBI, together with the Hillsborough County Sheriff's Office, alerted the Concord Police Department in May of potential crimes committed in Concord.

Detectives from Concord learned that Joubert has been involved in coaching youth baseball and hockey over the past 15 years, O'Malley said. Concord detectives identified possible victims and learned that multiple sexual assaults had occurred in Concord, according to O'Malley. All of the alleged victims were juveniles at the time of the assaults, he said.

As a result of the information developed in this case, Joubert was arrested Thursday by Concord detectives with assistance from New Hampshire State Police.

The investigation leading up to Joubert's arrest involved multiple law enforcement agencies, to include the Concord Police Department, FBI, York Police Department, Hillsborough County Sheriff's Office, Manchester Police Department, New Hampshire State Police, and the Pembroke Police Department.

A special phone number has been established for any member of the public who has information related to this investigation: (800) CALL-FBI or (800) 225-5324 (after calling hit prompt 9, then prompt 3). This number will be available for potential witnesses or victims to leave a voicemail anytime, police said. The voicemail will be checked three times a day and will be in place until late August. Information can also be reported to Concord police by calling (603) 225-8600 or the Concord Regional Crimeline at (603) 226-3100.

(AP) ? Calling it the next logical step in a near six-decade evolution, Rupert Murdoch's News Corp. said Thursday that it plans to split into two separate publicly traded companies.

Under the proposal, one company will operate as a newspaper and book publisher, while the other will be an entertainment company that includes the 20th Century Fox movie studio, the Fox broadcast TV network and the Fox News channel. It may take a year to work out the details.

The Murdoch family, which controls nearly 40 percent of the voting shares in News Corp., is expected to maintain control of both companies.

Rupert Murdoch said in a conference call with investors that a split would result in two strong companies that have more operational flexibility and be poised for greater growth.

"We've come a long way in our journey that began nearly 60 years ago with a single newspaper operating out of Adelaide," Murdoch said, referring to the single Australian newspaper he inherited from his father and became the foundation for News Corp.

"Each of these new companies would have the potential to continue that journey and prosper as an independent entity long into the future."

The split of News Corp. is a symbolic turning point for its 81-year-old media mogul. Through the years, Murdoch maintained a fondness for newspapers even as he purchased entertainment companies. In hearings last summer before U.K. lawmakers, he conceded that he regularly called newspaper editors under his employ with the greeting: "What's doing?"

Investors have already given their blessing to the split, having pushed shares of the company's Class B stock up 10 percent since the news of the plan broke early Tuesday. The shares edged down 15 cents to $22.26 in midday trading Thursday.

Under the current proposal, News Corp. shareholders will receive one share of common stock in the new company for each share of News Corp. that they currently hold. Each company would maintain two classes of stock.

Murdoch will serve as chairman of both companies and CEO of the media and entertainment company. The company said it plans to put together management teams and boards for both businesses over the next several months.

While News Corp.'s board unanimously approved pursuing a split, it will still need to approve any formal proposal. The deal is also subject to shareholder and numerous regulatory approvals.

News Corp. said it plans to hold a meeting of its shareholders sometime in 2013 and expects the deal to be completed in about a year.

Analysts relished the prospect that the faster growing pay TV segment would be valued more highly by new investors who weren't willing to buy shares in a company being dragged down by a newspaper industry in decline.

The publishing company, which will include The Wall Street Journal, is expected to be the much smaller of the two, with some analysts valuing it at about $5 billion, compared with the current market value for News Corp. as a whole of about $54 billion.

Murdoch emphasized on the call that the split doesn't mean that he's giving up on his publishing business, noting its "very strong" balance sheet and "robust" net cash position.

"The opportunity is so big, a single-minded pursuit is the best approach," Murdoch said. "Our aim is nothing less than this to create the most ambitious well-capitalized and highly motivated news and publishing company in the world."

Still, many analysts had questions about which entity would bear the financial risks of the ongoing U.K. probe into phone hacking and bribery. Besides legal costs, News Corp. also faces potential fines in the U.S. under the Foreign Corrupt Practices Act, which punishes companies that have bribed officials abroad.

Breaking off the newspaper and book publishing assets into a separate company makes them more "bite size" and ripe for being taken private by a third party, according to Needham & Co. analyst Laura Martin.

It is unclear if the split will appease the British telecommunications regulator, Ofcom, which is reviewing whether British Sky Broadcasting ? of which News Corp. holds a 39 percent stake ? is "fit and proper" to hold a broadcasting license. Ofcom is expected to wrap up its review later this summer.

British authorities have been probing allegations that News Corp. journalists at its now-shuttered News of the World and other papers hacked into phones and bribed public officials to gain exclusive information.

NEW YORK (CBSNewYork) ? Some say we?re on the brink of a new financial crisis ? one that revolves around staggering student loan debt.

Congress just voted against a scheduled interest rate hike on such loans, but millions of people ? many ready for retirement ? are still drowning in this debt.

Frank Freeman, 63, hasn?t taken a college course in nearly 40 years, but he?s still paying off an $80,000 student loan.

He didn?t use the money, but rather it was for his son?s college education. Because he co-signed the loan, he is now equally responsible for the debt. It?s not exactly what he had planned for his golden years.

?I thought I?d be retired, but I don?t see me retiring in the near future because of that,? Freeman said. ?If I have to keep working, I?ll keep working.?

Freeman is one of millions of 60-somethings still burdened by outstanding student loans.

Congress has passed legislation forestalling a sharp increase in interest rates on college loans, but many experts believe the student loan crisis ? especially among older Americans ? is reaching a breaking point.

?We have students, former students across the United States, who are really in a strangle hold,? said estate planner Ann Margaret Carrozza.

Carrozza said there are things you can do now to help pay it down.

?It?s imperative that someone who is having a little difficulty meeting their obligations contact the lender,? she said.

CBS 2?s Asa Aarons suggests people talk to their lender, adding they may be surprised at how willing they are to negotiate a better rate or new payment plan.

Carrozza also recommends consolidating your debt and ? in some cases ? it may make sense to refinance, take out a home equity loan or even mortgage a home that?s already paid off.

?It?s very important to get the word out and really research your options,? she said.

Not all 60-somethings are paying back their children?s loans. Many are paying back their own, having gone back to school later in life.

There is no time limit or statute of limitations on federal student loan collections, so government will seize portions of Social Security payments.

The Facebook boast: 60% of Britons take to social media to brag when on holiday

You would think that after working long hours to save up for our holiday abroad, all we would want to do is collapse on a sunlounger.

But it seems the first thing Britons on holiday do is brag on social media sites, with 60 per cent taking to Facebook and Twitter to boast about the fact they are away.

Research from T-Mobile revealed that four in ten Britons log on to Facebook and Twitter at least once a day whilst abroad and have dubbed the users who feel the need to brag online 'smoasters' - social media boasters.

More than 50 per cent of Britons have admitted to checking themselves in at a famous landmark, uploading smug shots of themselves at the beach or enjoying a fancy meal whilst on holiday, all to show off to their friends.

But 45 per cent of those question said they would only tag themselves in a location if it is glamorous and will make them look good.

According to the research, three in ten people say they would deliberately write a boastful holiday status to make people at home envious.

Six in ten defended their boasting, insisting that if they are happy they have a right to shout about it online.

Half said it?s fine because ?everyone else does it?, and four in ten do it just because they think it?s amusing to wind other people up.

An astounding 15 per cent of those polled admitted to boasting about their holiday online just to target an ex-partner they wanted to make jealous.

According tot he research, the Northern Irish are the most likely to ?smoast? whilst they are away, with 70 per cent admitting to posting status updates to brag about their trip.

Scots and Londoners aren't far behind, with 65 per cent admitting they had used social media sites to let everyone know where they are.

Whereas people from East Anglia (74 per cent) are most likely to get angry about other people?s Facebook and Twitter updates, with over half saying it is because they are showing off.

But it's not just regular people where they are on holiday, A-listers and reality stars are not averse to tweeting their holiday snaps.

The cast of The Only Way is Essex were found to be the most prolific braggers, closely followed by the cast of Made in Chelsea.

Rhianna, Tulisa and Victoria Beckham round off the top five social networking boasters when they are on their travels.

Psychologist Jo Hemmings said: 'We?re not an especially boastful nation ? we usually tend to play down our achievements but social networking has enabled us to post updates and photos about what we?re up to anywhere in the world.

'Posting updates on social networking sites, while we?re on holiday, is the modern day version of sending a postcard ? but of course is much more fun, having a wider audience and a far greater reach.'

A T-Mobile spokesperson said: 'With the holiday season fast approaching, more and more people will want to use social media whilst away on holiday. Dating can make you feel both excited and sick all at the same time. For someone looking for a relationship, not just a hook up, dating holds not only the hope for a bright and loving future but also the possibility of pain and heartbreak. Dating is rough. People aren't always what they seem. When you start the dating process, you are usually on your best behavior. But many people try to be someone they aren't in order to convince the person they are dating that they have found exactly who they were looking for. But that doesn't result in a happy ending. Sure, you want to be on your best behavior...put your best foot forward. But you still want to be yourself. The goal is not to dupe someone into being in a relationship with you. So what is one to do when they want to fellowship with other believers and meet someone special who just may end up being their soul mate? The obvious choice is to make an effort in getting involved with your Church or small group. Most churches have a singles group that gets together at least once, maybe twice, a week. You can also look into outreach. Focus on helping others and you may just find what you are looking for when you stop looking. But if you are really wanting to jump into dating feet first, try online dating.

There are many online dating websites available on the Internet today. Some are geared toward the general public and others are created specifically for Christians.

Even though some single Christians may feel self-conscious about stepping into the world of Online Dating, there is no reason. But when it comes to giving your heart to someone else, you need to give it to someone who shares your belief and your faith. Once you find the right Christina dating site and being to create your profile, be honest. Be yourself. Take to heart the fact that you are special and unique and deserving to find happiness. Do you have your faults? Absolutely. We all do. A little self-confidence and perspective can go a long way toward success in dating.

Youth hockey coach accused of tripping player on purpose

A youth hockey coach in Vancouver, BC is accused of purposely tripping a 13-year-old player, causing the boy to break his wrist.

In a video posted on YouTube, the coach identified as 40-year-old Martin Tremblay appears to intentionally put his leg out to trip the child during the traditional post-game handshake. Tremblay then points at the boy as he walks away.

Canada.com reports Tremblay?s team had just won the game, 5-4, last Saturday.

One parent said the coach had been trash talking the player, who scored the opening goal. The parent said the player had flipped off the coach, but also appeared to be visibly upset on the bench.

Tremblay reportedly has been suspended from the league and Candian Mounties are recommending an assault charge.
