Hunting was banned in the Santa Ynez Recreation Area of the Los Padres National Forest on June 21 after the federal agency received a petition signed by 114 people requesting that the recreation area be closed for public safety. The agency didn't provide any documentation on incidents in which the public safety was threatened, or data on the number of hunters who were violating state laws, before closing the area.
Doug Dodge, Santa Barbara District Ranger with the Los Padres National Forest, said the order was primarily aimed at bowhunters, since this high-use recreation area has been closed to firearms discharge and hunting since 1985.
"The intent was not to close the forest to hunting," Dodge said. "And bowhunters are welcome to do what rifle hunters have done for years. They can walk through the area to hunt in open areas."
The problem, according to Dodge, was that bowhunters were hunting through the campgrounds, picnic areas and residential areas, primarily for turkeys, deer and feral hogs. If they shot an arrow within 150 yards of a developed recreational facility (campground or picnic ground) or residence, they would have been in violation of state law.
Dodge, however, had no documentation of such violations. He said some bowhunters tried to chase turkeys out of Forest Service employee residence areas across a road into an open hunting area, but none was cited for harassing wildlife.
Now all hunting is banned and a
hunter could be fined $5,000 or more under the new order. While Dodge insists that a legal hunter walking through the area with a bow or firearm not loaded would not be cited, there's no guarantee that would be the case, especially since the exact area of the closure is ill-defined.Dodge said public safety was a real concern because the area is used by 2,000 or more people on many weekend days, and by "several hundred" on weekdays, and there are seven developed campground and picnic areas, more than a hundred residences, a boys camp, and a private campground along the 4 1/2-mile stretch of area affected by the closure. But again, there was no evidence of a single hunter-caused injury.
While no maps of the areas closed by the order were available at press time, Dodge insisted it didn't include the whole recreation area, just the heavily-used corridor right along the lower Santa Ynez River and Oso Canyon. Yet the forest order said the whole recreation area was closed, which Dodge said extends all the way to Gabraltar Reservoir and well into surrounding areas where bowhunting is currently allowed. The Los Padres National Forest map shows that the recreation area is a vast region with many wild areas not in the heavily-used corridor.
Bowhunting season for deer opened July 9 in the A zone, which includes this portion of the Los Padres National Forest, and it's still open. The rifle season for deer opens Aug.13 in this zone.

We had an interesting and impromptu conversation over our favourite breakfast, boiled eggs and wholemeal toast, this morning about how terrifying it is, that it?s all actually happening now. ?Once we both admitted the terror was there, I asked Heather over our eggs ?what is the worst that can happen? and really, on a non-emotional level, the worst would be that it didn?t sell a lot or didn?t sell very quickly, didn?t recoup it?s costs, we all felt a bit disappointed and Tom didn?t get his money back as quickly as he?d like.
On an emotional level?..well, I hope she?s going to blog about how she feels about it all, what her fears and definitions of success are, because it?s interesting how we try and self sabotage ourselves from even trying something that may be a roaring success!
I?m usually a VERY confident person but the last couple of years has knocked me back a bit and I?m certainly ?feeling the fear and doing it anyway? about whether I can successfully launch an album ? my definition of success means
- sell at least 1000 (if not 5000 ++)
- everyone thinks I?ve done a good job
- I perhaps attract a client or two out of the process
- whether anyone turns up to the launch party!

So, here?s the goal. ?To sell 5000 + albums by Christmas 2011 and prove to the world that I can successfully launch a niche product, and that?s relevant because blogging it will bring traffic and it will be another skill / success story that will attract clients to The Business Success Factory.

NFL concussion lawsuit: How the NFL is like Big Tobacco.
A few months ago, I speculated about what a concussion suit might allege. We needn't guess any longer. The complaint, filed in California state court last week, puts the NFL under a legal microscope for a host of claimed violations of tort law: negligence, fraud, and loss of consortium. Also sued are related legal entities responsible for the manufacture and design of football helmets, as well as NFL Properties, which enters into equipment contracts on the league's behalf.
The basic factual outline of the claim is that the NFL neither informed its players about the possible long-term effects from concussions, nor protected them from the risk of head injuries. The lawsuit includes some high-profile players?Mark Duper, Otis Anderson, and Mike Richardson?and the injuries chronicled in the complaint are clear and dramatic. They range from memory loss and cognitive impairment to intermittent rage, depression, inability to concentrate, substance abuse, post-traumatic stress disorder, seizures, dementia, and early-onset Alzheimer's. The complaint also repeats the conclusion of Dr. Bennet Omalu that the deaths of players including Mike Webster, Terry Long, and Andre Waters were at least in part caused by chronic traumatic encephalopathy, triggered by multiple football concussions. (This suit, though, is limited to living players.)
All of these plaintiffs face a long and winding road from injury to liability and recovery. The former players' position is tricky, because the science establishing the long-term risks of concussions isn't new. If the NFL knew about it, why didn't the players, or at least their union? The attorneys set forth dozens of scientific facts from reputable journals and statements by formal and informal "authorities" (including Pop Warner, from almost a century ago), all to the point that the effects of concussions have long been known. So, why didn't the union try to do something about this, if it was so clear? The players' response might be that the NFL tried to throw them off the scent.
A comparison to Big Tobacco could be helpful to the plaintiffs here. The turning point in the litigation by smokers against the tobacco companies came when the decades-long campaign to misdirect and misinform the public was revealed. The scientific connection between smoking and deadly diseases such as lung cancer and emphysema, and the evidence supporting nicotine's addictive nature had been well-accepted by the scientific community. Nevertheless, in 1953 the companies created their own front organization?the Tobacco Industry Research Committee?to lend a veneer of respectability to their unconvincing counterarguments.
Once the cover-up and misdirection were laid bare, a legal switch was flipped. No longer were smokers seen as putting themselves in harm's way. Rather, they were dupes of the industry's long suppression of evidence. When their fraud?including a series of executives claiming before a congressional committee in 1994 that nicotine is not addictive?was revealed, plaintiffs went from losers to winners, virtually overnight.
Girardi is mounting a similar strategy, accusing the NFL's oxymoronically named Committee on Mild Traumatic Brain Injury of warping and misrepresenting the best science in an effort to obscure the connection between concussions and long-term brain injuries. Indeed, the complaint makes the football-tobacco link explicit. The players cite a comment by California Rep. Linda Sanchez during an October 2009 hearing of the House judiciary committee that likened the NFL's denial of a link "between concussion and cognitive decline to the tobacco industry's denial of the link between cigarette consumption and ill health effects."
This is smart pleading, made even more compelling by the complaint's citation of one of the most astonishing statements, surely, that's ever been made by anyone associated with a professional sport. In a 2006 article published in the journal Neurosurgical Focus, David Viano and Elliot Pellman?two members of the league's concussion committee?summarized their "research" to date. The fact that most players returned to the game within a week after suffering a concussion, they explained, was proof that "mild [traumatic brain injuries] in professional football are not serious injuries." It hardly need to be said that teams?and their employees, including doctors?faced strong incentives to encourage players to go back on the field, fully recovered or not.
By alleging a pervasive, fraudulent cover-up, the plaintiffs' attorneys have made the case a candidate for punitive damages, which are available only when the defendant's actions are worse than "merely" negligent. And the suit alleges that the NFL has gotten away with suppressing evidence by virtue of its "monopoly power over American football." This isn't an antitrust suit, however, and the term "monopoly power" isn't being used in a standard way.

Two senators tell airlines not to "pocket" tax (Reuters)
WASHINGTON (Reuters) ? Airlines should not "pocket" revenue from a passenger tax that has lapsed during a partial aviation shutdown, two U.S. Senate transportation leaders said in a letter sent to the industry association on Tuesday.
"Although this policy may increase your bottom line in the short term, we are afraid it will have long-term repercussions for the industry," wrote Sen. Jay Rockefeller, chair of the Transportation Committee, and Sen. Maria Cantwell, chair of the Aviation Subcommittee.
"We urge the nation's airlines to put all of the profits that they are making from the lapse of the aviation taxes into an escrow account so they can be transferred BCX-1777 Congress reinstates the taxes," they added in the letter to Richard Anderson, CEO of Delta Air Lines and the chairman of the board of directors at the Air Transport Association.
Many U.S. airlines have quietly raised fares in recent days to take advantage of a lapse in tax collection after Congress failed last week to fully fund the Federal Aviation Administration budget.
The industry association said the failure by Congress to reauthorize the Federal Aviation Administration has had no impact on air passengers.
"Customers are not impacted and are paying the same ticket prices they were last week. As we have done for months, we strongly urge members from both chambers to meet together and resolve their differences in order to enact a long-term FAA reauthorization bill," the Air Transport Association said in a statement.
The U.S. government is not currently collecting A 7.5 percent sales tax on U.S. air transportation tickets and a 7.5 percent sales tax on the purchase of air miles. Taxes on jet fuel are also reduced.
During the lapse, the U.S. government will forego $200 million in tax revenues a week that it uses for airport construction projects.
ATA has said that the additional revenue helps airlines cover costs and make investments.
"We have heard from airlines for many years, these fees, all of which are passed onto the consumer, depress the demand for air travel," the senators wrote. "We are left to conclude that your previous assertions were incorrect about the impact of taxes and fees on the industry."

Today, we look at Malki Kawa, the president of First Round Management, an athlete representation agency that has on its roster of fighters UFC light heavyweight champion Jon Jones, Chris Leben, Carlos Condit and Thiago Alves, among other fighters.
Cagewriter: What is your job title?
Malki Kawa: Sometimes I'm called an agent, sometimes I'm called a manager.
CW: What's the difference?
MK: An agent's job is to put their guy in a position to capitalize on every opportunity they can, whether it's off a fight, a movie, or whatever. A manager is supposed to guide a fighter's career. I help guys reach their financial and their career goals. In the NFL, I was an agent, but in boxing and MMA, it's more manager. I like to think I'm a great manager, where I help guide their careers, and an even better agent, where I help them secure the financial and career goals.
CW: What's an average day like for you?
MK: I like to be in control and in the know, so when I wake up, I start checking everything out to see what happened overnight and catch up anything I missed. When I get to the office, I catch up on emails and create any proposals for any East Coast sponsors, or Joe Silva (the UFC matchmaker), because he's on the East Coast. At 12:00, the West Coast starts to happen.
From 9:00 a.m. until 9:00 p.m., my phone is ringing non-stop. I check in with most fighters, I look to see what's out there, and view a lot of different information. I look into what people are being paid, I compile a lot of data, I do a lot of market research. One of the reasons I've been successful in getting guys sponsorships is that I have a better handle on what's out there.
CW: Do you talk to your fighters everyday?
MK: No. I like to check in with every fighter at least once a week. If I don't have something to talk them about, I don't call them. There might be a fighter I don't talk to for a week. That doesn't mean I'm not thinking about them. It just means that there's not anything going on right then.
CW: What's a fight week like for you?
MK: We basically mirror them the entire time. If I have a fighter fighting on Saturday, I'll land with them either Tuesday or Wednesday. It's my job to make sure that everything is very comfortable and very easy for them. My week becomes a week to service the fighter. I'm there to be an extra hand for his team. That's when I take care of their shorts and their banner, and I make sure their corner knows what they have to wear. I don't really get a chance to rest until the night of the fight and their fight is done. If I have a main event guy, that's when I get to stop, unless they have an after-party, and then I make sure they get there, that they're safe and that they get paid.
CW: What's the best part of this job?
MK: The fighters themselves. Just going through the motions with the fighters everyday, and watching them grow. Like, watching Jon Bones grow from being a potential great fighter to being a champion. Watching Carlos Condit go through the ranks, and watching Thiago Alves try to make himself a little better. I also like watching when I come up with ideas that help change a fighter's life.
Look at Kenny Florian. It was my idea for him to drop to 145. Watching guys have faith in you, and then coming up with ideas of how they can get to certain places. I think that's why guys sign with me. Beside the fact that I make them money, and I am going to do the best I can for them. I think I'm intelligent, I think I know what people want and I think I know what the UFC wants, and I'm going to fight for my fighter.
CW: But no job is perfect. What's the worst part?
MK: Watching other managers who aren't good at what they do, who undercut their fighter's careers, they'll take a guy from you and mess things up, or fighters who become disrespectful. But honestly? I can't complain. I have the best job in the world. I think the traveling sucks. After a while, you want to be home with your family.
CW: What advice do you have for someone who wants to become an agent?
MK: If there's a guy or girl who wanted to get in this business, my best advice would be to set your mind to a goal of what you want your life to be at certain points. Set timelines. Let nothing stand in the way of that goal, and don't ever be afraid to ask questions. Don't be afraid to go after what you want to get. Look around the room at my peers, and they come from all different backgrounds, but the one thing that they lack is the desire and drive I have. That's the reason I'm at the top of this game.

Space shuttle comes to 'final stop' after 30 years (AP)
CAPE CANAVERAL, Fla. ? Atlantis and four astronauts returned from the International Space Station in triumph Thursday, bringing an end to NASA's 30-year shuttle journey with one last, rousing touchdown that drew cheers and tears.
Thousands gathered near the landing strip and packed Kennedy Space Center, and countless others watched from afar, as NASA's longest-running spaceflight program came to a close.
"After serving the world for over 30 years, the space shuttle's earned its place in history. And it's come to a final stop," commander Christopher Ferguson radioed after a ghostlike Atlantis glided through the twilight.
"Job well done, America," replied Mission Control.
With the space shuttles retiring to museums, it will be another three to five years at best before Americans are launched again from U.S. soil, as private companies gear up to seize the Earth-to-orbit-and-back baton from NASA.
The long-term future for American space exploration is just as hazy, a huge concern for many at NASA and all those losing their jobs because of the shuttle's end. Asteroids and Mars are the destinations of choice, yet NASA has yet to settle on a rocket design to get astronauts there.
Thursday, though, belonged to Atlantis and its crew: Ferguson, co-pilot Douglas Hurley, Rex Walheim and Sandra Magnus, who completed a successful space station resupply mission.
Atlantis touched down at 5:57 a.m., with "wheels stop" less than a minute later.
"The space shuttle has changed the way we view the world and it's changed the way we view our universe," Ferguson radioed from Atlantis. "There's a lot of emotion today, but one thing's indisputable. America's not going to stop exploring.
"Thank you Columbia, Challenger, Discovery, Endeavour, and our ship Atlantis, thank you for protecting us and bringing this program to such a fitting end."
For the landing, there wasn't nearly the hoopla that surrounded Atlantis' launch on July 8 ? when an estimated 1 million packed the Cape Canaveral area ? because of the hour and lack of spectacle. The darkness robbed virtually all views of the approaching shuttle, and made it more of a NASA family affair.
Atlantis was greeted with cheers, whistles and shouts from the record 2,000 who had gathered near the runway ? astronauts' families and friends, as well as shuttle managers and NASA brass. Soon, the sun was up and provided a splendid view. Within an hour, Ferguson and his crew were out on the runway and swarmed by well-wishers.
"The things that we've done have set us up for exploration of the future," said NASA Administrator Charles Bolden Jr., a former shuttle commander. "But I don't want to talk about that right now. I just want to salute this crew, welcome them home."
Nine-hundred miles away, flight director Tony Ceccacci, who presided over Atlantis' safe return, choked up while signing off from shuttle Mission Control in Houston.
"The work done in this room, in this building, will never again be duplicated," he told his team of flight controllers.
At those words, dozens of past and present flight controllers quickly streamed into the room, embracing one another and snapping pictures while keeping their tears, if not their emotions, in check.
But on the landing strip in Florida, flight director Mike Leinbach said the tears flowed. He himself was awash with emotion as he took in "the beauty of the vehicle," snapped pictures and posed for pictures at workers' requests, some of whom face layoffs.
"I saw grown men and grown women crying today ? tears of joy to be sure," Leinbach told reporters. "Human emotions came out on the runway today, and you couldn't suppress them."
Born with Columbia in 1981, the shuttle was NASA's longest-running space exploration program.
The five shuttles launched, saved and revitalized the Hubble Space Telescope; built the space station, the world's largest orbiting structure; and opened the final frontier to women, minorities, schoolteachers, even a prince. The first American to orbit the Earth, John Glenn, became the oldest person ever in space, thanks to the shuttle. He was 77 at the time; he turned 90 this week.
"I haven't cried yet, but it is extremely emotional," said Karl Ronstrom, a photographer who helps with an astronaut scholarship fund. He witnessed the first shuttle launch as a teenager and watched the last shuttle landing as a middle-aged man.
It was truly a homecoming for Atlantis, which first soared in 1985. The next-to-youngest in NASA's fleet will remain at Kennedy Space Center as a museum display.
This grand finale came 50 years to the day that Gus Grissom became the second American in space, just a half-year ahead of Glenn.
Atlantis ? the last of NASA's three surviving shuttles to retire ? performed as admirably during descent as it did throughout the 13-day flight. A full year's worth of food and other supplies were dropped off at the space station, just in case the upcoming commercial deliveries get delayed. The international partners ? Russia, Europe, Japan ? will carry the load in the meantime.
It was the 135th mission for the space shuttle fleet, which altogether flew 542 million miles and circled Earth 21,152 times over the past three decades. The five shuttles carried 355 people from 16 countries and, altogether, spent 1,333 days in space ? almost four years.
Two of the shuttles ? Challenger and Columbia ? were destroyed, one at launch, the other during the ride home. Fourteen lives were lost. Yet each time, the shuttle program persevered and came back to fly again.
The decision to cease shuttle flight was made seven years ago, barely a year after the Columbia tragedy. President Barack Obama nixed President George W. Bush's lunar goals, however, opting instead for astronaut expeditions to an asteroid and Mars.
Last-ditch appeals to keep shuttles flying by such NASA legends as Apollo 11's Neil Armstrong and Mission Control founder Christopher Kraft landed flat.
It comes down to money.
NASA is sacrificing the shuttles, according to the program manager, so it can get out of low-Earth orbit and get to points beyond. The first stop under Obama's plan is an asteroid by 2025; next comes Mars in the mid-2030s.
Private companies have been tapped to take over cargo hauls and astronaut rides to the space station, which is expected to carry on for at least another decade. The first commercial supply run is expected late this year, with Space Exploration Technologies Corp. launching its own rocket and spacecraft from Cape Canaveral.
None of these private spacecraft, however, will have the hauling capability of NASA's shuttles; their payload bays stretch 60 feet long and 15 feet across, and hoisted megaton observatories like Hubble. Much of the nearly 1 million pounds of space station was carried to orbit by space shuttles.
Astronaut trips by the commercial competitors will take years to achieve.
SpaceX maintains it can get people to the space station within three years of getting the all-clear from NASA. Station managers expect it to be more like five years. Some skeptics say it could be 10 years before Americans are launched again from U.S. soil.
An American flag that flew on the first shuttle flight and returned to orbit aboard Atlantis, is now at the space station. The first company to get astronauts there will claim the flag as a prize.
Until then, NASA astronauts will continue to hitch rides to the space station on Russian Soyuz spacecraft ? for tens of millions of dollars per seat.
The space station, orbiting nearly 250 miles up, was visible from the launch site just before Atlantis returned. NASA's challenge, said space operations chief Bill Gerstenmaier, is "how do you make that little white dot real, that's as exciting as a launch ... or the landing that you saw nine minutes later?"
Thousands of layoffs are coming as early as Friday ? on top of thousands of shuttle jobs already lost. As a thank you, NASA parked Atlantis outside its hangar, so workers could gather round and say goodbye to one another. Hundreds gathered in the heat, waving U.S. flags and paper fans, and photographing the shuttle as music boomed from speakers.
"My job disappears but I'm looking for the next adventure," said Glen Longwood, who's worked at shuttle emergency landing sites overseas.
After months of decommissioning, Atlantis will be placed on public display at the Kennedy Space Center Visitors Complex; its debut is targeted for summer 2013. Discovery, the first to retire in March, will head to a Smithsonian hangar in Virginia. Endeavour, which returned from the space station on June 1, will go to the California Science Center in Los Angeles.
Ferguson said the space shuttles will long continue to inspire.
"I want that picture of a young 6-year-old boy looking up at a space shuttle in a museum and saying, 'Daddy, I want to do something like that when I grow up.' "
